Privacy Act 1993

Auckland Council is subject to the Privacy Act 1993 (New Zealand). The Privacy Act is supervised by the New Zealand Privacy Commissioner.

The Privacy Act 1993 contains twelve ‘Information Privacy Principles’ that govern the collection, use, and disclosure of personal information (i.e., information about an identifiable individual). The subject matter of each Information Privacy Principles is as follows:

3. Collection of information from subject
4. Manner of collection of personal information
5. Storage and security of personal information
6. Access to personal information
7. Correction of personal information
8. Accuracy, etc, of personal information to be checked before use
9. Agency not to keep personal information for longer than necessary
10. Limits on use of personal information
11. Limits on disclosure of personal information
12. Unique identifiers.

 

Collection and use of personal information

Personal information is not collected on this Website unless it is volunteered.

The purpose(s) for collecting personal information will be clear in such cases and the information will not be used for any other, unrelated purpose. Only those involved in providing the service associated with the purpose (including any required technical support) will have access to the personal information.

You can browse this Website without disclosing any personal information.
Personal information that is already held in public records may be accessible on this Website.

This Website does not use cookies to store personal data and nor does this Website link non-personal information stored in cookies with personal data about specific individuals. This Website uses cookies solely to retrieve aggregate information to perform analyses of the characteristics and behaviours of website users and in order to make improvements to the site. This information is not used to identify individual website users.

Any New Zealand citizen, permanent resident of New Zealand, or individual who is in New Zealand is entitled to request access to the personal information held about him/her by the Auckland Council.

If Auckland Council holds personal information about an individual, the individual concerned is entitled to request correction of the information and to request that there be attached to the information a statement of any correction sought but not made.

 

Storage and security of personal information

 Auckland Council is developing enhanced web-based services. When any services are provided which involve visitors sending personal financial information to this Website, a secure transmission method will be used.

All Auckland Council employees and data processors who have access to, and are associated with the processing of, personal data are obliged to respect the confidentiality of our visitors’ personal data.

 

Effect of other laws

Auckland Council has obligations under other laws, including the Local Government Official Information and Meetings Act 1987 (New Zealand), which makes official information held by local authorities more freely available, while protecting official information held by local authorities and the deliberations of local authorities to the extent consistent with the public interest and the preservation of personal privacy. Complaints about decisions made by local authorities on requests under the Local Government Official Information and Meetings Act can be made to the New Zealand Ombudsmen.

The undertakings given above in regard to privacy of personal information may be affected by council’s obligations under laws which require the council to make information available to the public.
